§ 90.24 PIT BULL TERRIERS.

(A) No person shall own, keep, possess, control

or have in his or her possession or control, or harbor

or shelter a pit bull terrier, as defined herein, within

the municipal limits of the village. PIT BULL

TERRIER as used herein is defined as any

Staffordshire Bull Terrier or American Staffordshire

breed of dog, or any mixed breed of dog which

contains as an element of its breeding the breed of

Staffordshire Bull Terrier or American Staffordshire

Terrier.

(B) This section is a necessary control to

eliminate the risk of attack by pit bulls, as defined in

this section, on human beings and property in the

village, which has become a threat to the health,

safety and welfare of the public in all areas of the

village, and the lack of knowledge or lack of intent is

not a defense to any violation of this section.

(C) A pit bull terrier as defined in this section

may be identified by a veterinarian licensed by the

state, or by the county dog warden, or by a deputy

county dog warden.
